In 2018, after having seen an opportunity to do business in the UK, Mr K, a Pakistani national decided to establish 2 companies, one in the health and fitness sector and one in furniture retail sector. By providing full advice on business plan, business structure, tax, human resources and other operational side of prospective companies, NIDO represented Mr K to successfully apply for entry clearance as a Tier 1 Entrepreneur alongside his dependents which was set to expire in June 2021.

After 3 years, Mr K came to NIDO again and wished to apply for Indefinite Leave to Remain in the UK as a Tier 1 Entrepreneur.


Generally, under the Immigration Rules, the Tier 1 Entrepreneur Visa holders needs to extend their visa for another 2 years to meet the requirement for Indefinite Leave to Remain in the UK. Therefore, the question is how to do so without applying for 2-year extension?



How did NIDO help Mr K and his dependents to apply for Indefinite Leave to Remain?


After assessing the situation, NIDO agreed to assist Mr K for his indefinite leave to remain application under the Tier 1 Entrepreneur Accelerated Route, which means there were more requirements that Mr K had to meet to be granted indefinite leave to remain in the UK after just 3 years.


Our team had to conduct a detailed due diligence of the investment. Further, we also assessed the operation, HR, director loans, tax documents, and other financial requirements to ensure that Mr K satisfied requirements as laid out in Tier 1 Entrepreneur Accelerated Route part of the Immigration Rules.


Having outlined to Mr K the requirements from the offset we advised him on his documents and then once the documents and information required were in order, we compiled his application for Indefinite Leave to Remain and then filed this with the Home Office.


We managed to secure appointments for Mr K and his dependents as required by him and ensured that on the day of his appointment Mr K had the most streamlined service available to him.


Whilst preparing the applications we also outlined to the Home Office how Mr K met the rules for this application and paid particular attention to the requirements under paragraph 245DF of the immigration rules which are available to read at here.


In addition to the above we also ensured that Mr K did not fall foul of any of the requirements which the Home Office follows when making a decision on these applications, this guidance which is an all important factor in these applications can be found here.


Result


Within 2 months, our team has successfully applied for Indefinite Leave to Remain for Mr K to stay in the UK and develop his businesses which he will continue to do and employ the settled workers which shows the benefit of his investments in the UK.
